Student scientific conferences on constitutional justice. International conference “Current problems of constitutional law

This year, a new discipline “Constitutional Justice” has appeared in the curriculum of the International Law Faculty, which is studied by 3rd year undergraduate students in the second semester. The interest that students showed in the new subject and their desire to understand the nuances of the topic prompted the Political and Legal Research Club to hold student scientific conferences with a general focus on “Constitutional Justice” together with the Department of Constitutional Law.

The following form was chosen for the implementation: willing-potential participants were offered one general topic, within the framework of which it was intended to discuss all possible aspects of the issue.

The first such conference took place on May 18 and was devoted to discussing the topic “Constitutional Court: negative or positive legislator?”
The theme of the second conference (May 19) was designated as follows: “Judicial activism in the activities of constitutional justice.”

In both cases, the moderators were teachers of the Department of Constitutional Law K.A. Polovchenko and V.B. Chernoletsky, and among those willing to speak were 1st-3rd year students of the Faculty of International Law and the Faculty of International Relations. It was all the more interesting to discuss problems at the interfaculty level - different approaches, different points of view! Not listing all the issues discussed, but just mentioning some already shows the breadth of coverage and detail of the discussion.

At the first conference they considered both theoretical issues, for example, “Legal positions of the constitutional court as a legal phenomenon”, “Bodies of constitutional justice in the post-Soviet space as subjects of the formation of law”, “The Constitutional Court in the role of a legislator: the creation by constitutional courts of their own powers in the field of judicial supervision”, and quite specific ones, according to various countries: constitutional courts of Austria, Spain, the Baltic countries, Bosnia and Herzegovina.

The speeches and further scientific discussion on May 18 allowed us to come to the conclusion: the body of constitutional justice at the present stage is acquiring a fundamentally new status. Being a “negative legislator”, he receives the characteristic features of a “positive legislator”, qualitatively influencing the constitutional legislation of the corresponding state with his legal positions.

The second conference became no less bright and interesting. We started with a discussion of points of view on judicial activism, methods for assessing judicial activism, the doctrine of judicial activism in the USA and continued on a practical level: “Judicial activism of constitutional courts in a democratic state”, “Activism and originalism in the activities of the US Supreme Court”, judicial activism in countries of Latin America, the Baltics, France, Turkey, Armenia, Russian Federation. Some of the speeches, for example, “Landmark cases against Ukraine through the prism of the doctrine of judicial activism,” caused a heated discussion, which it was decided to continue later.

In general, the discussion during the conference on the topic of judicial activism led to the conclusion that the modern trend shows a special role for judges in making the most important decisions regarding the prospects for the development of the constitutional system of the state. Constitutional courts are increasingly showing signs of a high areopagus, designed to ensure total protection of rights and freedoms, both individual and collective.

The conference was organized by the Department of Constitutional and Municipal Law of the Law Faculty of Moscow State University. M.V. Lomonosov with the support of the Interregional Association of Constitutionalists of Russia, as well as the journal “Constitutional and Municipal Law”. More than 180 constitutional scholars from different regions of the Russian Federation, as well as CIS and foreign countries took part in its work, and more than 50 people made presentations. The plenary session opened with a report by the head of the Department of Constitutional and Municipal Law of the Law Faculty of Moscow State University S.A. Avakyana. He noted the need to develop new directions in science constitutional law, as well as rethinking existing concepts. Report by the Chairman of the Council under the President of the Russian Federation for the Development of Civil Society and Human Rights M.A. Fedotov was devoted to topical issues of ensuring information rights. The speeches made at the plenary session also touched upon the problems of institutional development constitutional law in the member states of the European Union in the context of strengthening European integration (T.A. Vasilyeva, Institute of State and Law of the Russian Academy of Sciences; E. Tanchev, Advocate General of the Court of Justice of the EU, Bulgaria); interaction of national and international mechanisms for the protection of human rights (A. di Gregorio, University of Milan, Italy), multi-vector development of modern law and the role of constitutional law in this process (Yu.A. Tikhomirov, Institute of Legislation and Comparative Law under the Government of the Russian Federation), constitutional justice (N.S. Bondar, judge of the Constitutional Court of the Russian Federation), modern development constitutional law(B.S. Ebzeev and E.I. Kolyushin, members of the Central Election Commission of the Russian Federation; G.A. Vasilevich, Belorussky State University) and the need for a new reading of the Russian Constitution (A.A. Liverovsky, St. Petersburg State Economic University), organization local government(A.N. Didenko, Chairman of the State Duma Committee on Federal Structure and Issues local government; A.M. International scholarly conference “Constitutional law: development, problems and perspectives” (15-19 March 2017)

The international science conference “Constitutional Law: Development, Problems and Perspectives” organized by the Constitutional and Municipal Law Department at Law Faculty of the Lomonosov Moscow State University with support from the Inter-Regional Association of Russian Constitutionalists and academic and research journal “Constitutional and Municipal Law". More than 180 constitutional law scholars from Moscow, other Russian regions, CIS countries and other states participated in the conference, and more than 50 participants presented their reports. The plenary session was opened by Professor Suren A. Avakiyan, Chair of the Constitutional and Municipal Law Department, Law Faculty of the Lomonosov Moscow State University. Suren A. Avakiyan stressed the demand for developing new streamlines in the constitutional law science, as well as for rethinking the existing concepts. Professor Mikhail A. Fedotov, Chairman of the Presidential Council for Civil Society and Human Rights, discussed pressing matters of development of constitutional legislation relating to the area of ​​information rights. The following reports continued the plenary session: The problems of the development of constitutional law in EU member-states in the context of European integration (Professor T.A. Vasilieva, Institute of State and Law, Russian Academy of Sciences; E. During the conference, the following panel sessions took place: “Constitutional order, democracy and parliamentarism”, “Rights, freedoms and responsibilities of man and citizen”, “Federalism and local self-government”. A visit to the State Duma was organized for the participants.

On October 7–8, 2011, the international conference “Current Problems of Constitutional Law” was held at the Faculty of Law of Moscow State University, organized on the initiative of the faculty’s NSO with the support of the departments of constitutional and municipal law; criminal process, justice and prosecutorial supervision; forensics.

At the opening ceremony of the conference the Deputy Dean for scientific work, Professor N.V. Kozlova, assistant dean for educational work E.N. Veretko, member of the International Tax Association A.A. Timonina, representative of the company "Garant" G.A. Mardanova and a representative of the company "Consultant Plus" V.V. Popova.

There were three sections at the conference:

  • “Implementation of constitutional rights of the individual in criminal and civil proceedings” (under the guidance of associate professor of the department of criminal procedure, justice and prosecutorial supervision D.P. Chekulaev, assistant of the department of criminology E.S. Kryukova, graduate student of the department of criminal procedure, justice and prosecutorial supervision, chairman of the NSO Faculty of Law of Moscow State University named after M.V. Lomonosov, public assistant to the investigator of the RF IC A. Trefilov),
  • “Current problems of Russian federalism” (under the leadership of member of the International Tax Association M.A. Timonina),
  • “Current problems of the activities of state and municipal bodies” (under the guidance of the head of the department of constitutional and municipal law, Doctor of Law, Professor S.A. Avakyan, expert D. Salikhov).

At the end of the sectional sessions, a teleconference was held with Samara State University, followed by parliamentary debates on constitutional law.

More than 50 students from 15 universities spoke at the conference, including: Moscow State University named after M.V. Lomonosov, Kyiv National University named after Taras Shevchenko, National Law Academy of Ukraine, Belarusian State University, Moscow University of the Ministry of Internal Affairs of the Russian Federation, St. Petersburg State University, St. Petersburg Law Institute (branch) of the Academy of the Prosecutor General's Office of the Russian Federation, Russian Academy of Justice, Russian New University, Russian Law Academy Ministry of Justice of the Russian Federation, Chelyabinsk Law Institute of the Ministry of Internal Affairs of Russia, Russian State Social University, Kurgan State University, Voronezh State University.
